These Terms of Use describe how you may access and use the Psych of Sales website and related services. By using this site, submitting a form or engaging with our services, you agree to these terms.
If you do not agree to these Terms of Use, please do not use this website.
1. Who we are
Psych of Sales (“we,” “us,” “our”) is a sales pod and appointment-setting partner that helps US-based B2B companies work with native-language setters and closers. We operate this website at psychofsales.com and related pages (the “Site”).
These Terms of Use apply to your use of the Site and to any information you submit through our forms (e.g., “Run the Math” and “Work With Us”), but they do not replace or override any separate written agreement you may sign with us as a client or contractor. If there is a conflict between these Terms and a signed agreement, the signed agreement controls.
2. Eligibility & acceptable use
By using this Site, you represent that you are at least 18 years old and have the legal capacity to enter into binding agreements. You may use the Site only for lawful purposes and in accordance with these Terms of Use.
- Do not submit false, misleading or fraudulent information in any form or message.
- Do not attempt to gain unauthorized access to our systems, data, or any accounts.
- Do not use the Site to harass, abuse, or harm others or to promote illegal activities.
- Do not copy, scrape, or attempt to reverse engineer any part of the Site or our systems.
3. Informational content, not guarantees
Everything on this Site (case studies, examples, calculators, “Run the Math” outputs, etc.) is for informational and marketing purposes only. Past performance — including appointment volume, revenue, or campaign results — does not guarantee future performance for any client or partner.
Any projections or “owner’s math” we share are based on assumptions and information you provide. They are not financial, legal, tax or investment advice. You are responsible for your own business decisions and for validating whether a sales pod model is appropriate for your situation.
4. Client & talent interactions
We serve two primary audiences through this Site:
- Clients – US-based B2B companies that may engage Psych of Sales to design and operate multilingual sales pods or provide related services.
- Talent – appointment setters, SDRs, closers and other sales professionals who may apply to work in or with our pods.
Submitting a form on this Site (as a client or as talent) does not create a contract, employment relationship, partnership, agency or joint venture by itself. Any engagement with us or with our clients is subject to separate written terms (such as a services agreement, SOW, or contractor agreement) that will be provided and agreed to separately.
5. Fees, payment & engagement terms
Pricing, payment terms, minimum commitments, and pod compensation structures (including base fees, performance components, and payouts to talent) are not fully defined on this Site. They are discussed case by case and, for clients and talent, will be set out in separate written agreements.
Nothing on this Site obligates us to work with any particular client or candidate, or to maintain any given pricing or engagement model. We reserve the right to decline work or applications at our discretion.
6. Intellectual property
The Site and its content — including text, graphics, logos, layouts, case studies, and any branding (“Content”) — are owned by us or our licensors and are protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to access and view the Content for your own internal, non-commercial use (e.g., evaluating whether to work with us).
You may not copy, reproduce, distribute, modify, or create derivative works from the Content without our prior written consent, except as allowed by applicable law (e.g., brief quotations with attribution).
7. Data, privacy, analytics & AI-powered tools
When you use this Site or submit a form, we collect and process certain information about you (for example, your name, email, company, role, markets and performance data). How we collect, use, store and share this information is described in our Privacy Policy, which is incorporated into these Terms by reference.
We may use analytics and advertising tools (such as Google Analytics, Google Ads, and related platforms) to understand traffic, measure performance, and run remarketing or similar campaigns. These tools may set cookies or use similar technologies to track activity across pages and sessions. Where required, we obtain your consent or provide controls via a cookie banner or browser settings.
We also use internal systems built on the Model Context Protocol (MCP) and AI models (including OpenAI’s ChatGPT) to help route, score and organize form submissions and other data. For example, we may use MCP-powered tools to:
- Classify leads as client vs talent and tag them by language, market or vertical.
- Summarize your responses so our team can review them more efficiently.
- Support internal decision-making about fit, prioritization and next steps.
These tools assist our human team; they do not make final binding decisions by themselves. Use of MCP and AI is subject to our Privacy Policy and to the terms and policies of the AI and infrastructure providers we rely on.
8. Third-party tools and links
The Site may link to or rely on third-party tools and services, such as CRMs, calendars, form providers, analytics platforms, AI infrastructure, or partner websites. We do not control and are not responsible for third-party websites, services or their content, policies or security practices.
Your use of any third-party tool or service is at your own risk and may be governed by the third party’s own terms and privacy policies.
9. Disclaimers
The Site and all Content are provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied. To the fullest extent permitted by law, we disclaim all warranties, including any implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising from course of dealing or usage of trade.
We do not warrant that the Site will be uninterrupted, secure or error-free, that defects will be corrected, or that the Site is free of viruses or other harmful components. We do not warrant or guarantee any particular number of appointments, meetings, deals, revenue, profit, or other business outcomes.
10. Limitation of liability
To the fullest extent permitted by applicable law, in no event will Psych of Sales, its owners, employees, contractors or agents be liable for any indirect, incidental, consequential, special, exemplary or punitive damages, or for any loss of profits, revenue, data or business opportunities, arising out of or in connection with your use of the Site or reliance on any Content.
To the extent we are found liable for any direct damages arising out of or related to your use of the Site, our total aggregate liability will not exceed one hundred US dollars (USD $100), or the minimum amount required by applicable law if higher.
These limitations do not limit or exclude liability that cannot be limited or excluded under applicable law.
11. Indemnification
You agree to indemnify, defend and hold harmless Psych of Sales and its owners, employees, contractors and agents from and against any claims, liabilities, damages, losses and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of the Site; (b) your violation of these Terms of Use; or (c) your violation of any rights of another person or entity.
12. Changes to the Site and to these terms
We may update, modify or discontinue any part of the Site at any time, with or without notice. We may also update these Terms of Use from time to time. When we do, we will change the “Last updated” date below and may post a notice on the Site.
Your continued use of the Site after changes are posted means you accept the updated Terms. If you do not agree to the updated Terms, you should stop using the Site.
13. Governing law & venue
These Terms of Use are governed by and construed in accordance with the laws of the State of Illinois, United States of America, without regard to its conflict of law principles.
Any disputes arising out of or relating to these Terms or your use of the Site will be resolved exclusively in the state or federal courts located in Illinois, and you consent to the personal jurisdiction of those courts.
